The Chairman thanked everyone for attending the re-convened meeting.

To re-convene the meeting of the Special Development Management Committee to consider Planning Application No. CB/12/03613/OUT.

Minutes:

 

In advance of consideration of the following Planning Applications the Committee received a Late Sheet version 2, along with the original Late Sheet that had been issued in conjunction with the meeting on 28 August 2013 advising it of additional consultation/publicity responses, comments and proposed additional/amended conditions. Copies of both Late Sheets had been circulated prior to the meeting.

 

In addition to the Late Sheets the Committee received a Briefing Note which set out observations in respect of correspondence received from Luton Borough Council who had raised a number of issues in respect of the planning application.  The Briefing Note had been prepared following receipt of legal advice from Counsel.  A copy of the document was circulated at the meeting.

 

During consideration of the Application the Committee received a representation from the Managing Director of the Houghton Regis Planning Consortium in accordance with the Public Participation Procedure as set out in Annex 3 of Part A4 of the Constitution.

To consider whether to pass a resolution under section 100A of the Local Government Act 1972 to exclude the Press and Public from the meeting for the following item of business on the grounds that the consideration of the item is likely to involve the disclosure of exempt information as defined in paragraph(s) 3 of Part 1 of Schedule 12A of the Act.

The Committee resolved to exclude the Press and Public for consideration of Appendix A to the report and Page 21 of the Late Sheet (version 1 in conjunction with meeting convened on 28 August 2013) as defined in paragraphs 3 of Part 1 of Schedule 12A of the Act.

Outline planning permission with the details of access, appearance, landscaping, layout and scale reserved for later determination. Development to comprise: up to 5,150 dwellings (Use Class C3); up to 202,500 sqm gross of additional development in Use Classes: A1, A2, A3 (retail), A4 (public house), A5 (take away); B1, B2, B8 (offices, industrial and storage and distribution); C1 (hotel), C2 (care home), D1 and D2 (community and leisure); car showroom; data centre; petrol filling station; car parking; primary substation; energy centre; and for the laying out of the buildings; routes and open spaces within the development; and all associated works and operations including but not limited to: demolition; earthworks; engineering operations. All development, works and operations to be in accordance with the Development Parameters Schedule and Plans.

RESOLVED

 

That, subject to the prior consultation of the Secretary of State, in accordance with The Town and Country Planning (Consultation) (England) Direction 2009, the completion of a Section 106 Agreement and any necessary revisions to conditions be delegated to The Head of Development Management in consultation with the Chairman, Vice-Chairman and Executive Holder for Sustainable Communities, Strategic Planning and Economic Development. The Head of Development Management then be authorised to grant Planning application No CB/12/0361/OUT Houghton Regis North (HRN1), Land to the Northern edge of Houghton Regis Bedfordshire subject to no call in being made by the Secretary of State and Conditions as set out in the Schedule appended to these minutes.
